This Privacy Policy “(Policy”) outlines the information TuCielo Association Financing and Ygrene Energy Fund, (collectively referred to as “TuCielo”) collects, uses, and as applicable discloses, including why it is collected, and how you can update your information.
This Policy applies to information that users and visitors such as borrowers, consumers, property owners, contractors, participating municipalities, etc. provide to TuCielo’s website, mobile applications, phone, or any other TuCielo system (“Systems”). Please be aware that other third-party websites that you may access to link to or through TuCielo Systems, may also collect personally identifiable information about you. Our Policy does not cover those third-party websites, and we encourage you to read their privacy policies prior to providing them with your personal information.
If you do not agree with our Policy and practices, your choice is to not use TuCielo Systems. By accessing or using our Systems, you agree to this Policy. TuCielo Systems are intended for U.S. residents 18 years of age and above. This Policy may change from time to time. Use of our Systems after we make changes is deemed to be acceptance of those changes, so please check this Policy periodically for updates.
PERSONAL INFORMATION
“Personal Information” is information that identifies you as an individual or relates to an identifiable individual. TuCielo may collect Personal Information from you via the Systems when you choose to share it with us, including the following categories:
- Identifiers, such as a real name, postal address, Internet Protocol address (“IP Address”), date of birth, email address, telephone number, account name, or other similar identifiers. This also includes any other Personal Information you share with us while using our Services;
- Protected classification characteristics and sensitive Personal Information, such as your Social Security number, veteran or military status, gender identity, ethnicity and primary language;
- Financial information, such as your mortgage loan balance and related financial information, when you choose to share them with us;
- Professional or employment-related information, such as your current occupation, level of completed education, and income;
- Geolocation data, which may be derived from your IP address or mobile device;
- Information from your device, such as your device’s contacts, photos, and location, when you choose to share them with us;
- Account information, including your account log-in information for third-party websites; services, or applications, like Facebook, Instagram, and Google, when you choose to link these accounts to TuCielo Websites or TuCielo Apps; and
- Other Information (as defined below), to the extent TuCielo is required to treat such information as Personal Information under applicable law.
HOW DOES TUCIELO COLLECT AND USE YOUR INFORMATION?
TuCielo collects Personal Information in our Systems in order to provide the requested services to you, improve upon our existing services, and develop new products or services. If you do not provide the Personal Information requested, TuCielo may not be able to provide you with the services you requested.
TuCielo may collect and use your Personal Information to:
- Directly request information through Systems, for example when you submit an application for financing, or complete a contact information form, apply to be an approved contractor, submit an inquiry or request additional information, or contact us via telephone, mobile phone, or email;
- Accomplish legitimate business purposes such as data analysis to improve efficiency, audits to verify internal processes, developing new products and services, enhancing current products and services, for identifying usage trends, determining effectiveness of promotional campaigns;
- Respond to your requests for TuCielo financing and TuCielo information;
- Provide your information to third parties that you have authorized;
- Request for and to verify contractor license information;
- Carry out contractual obligations entered between you and us;
- Further our marketing programs;
- Obtain information through your browser or device;
- Further our affiliates’ business purposes, and to market their products and services to you;
- Notify you about changes to our Systems or any products or services TuCielo offers through it;
- Further our use of cookies, pixel tags, and other similar technologies;
- Further any other business purpose with your consent.
Certain information TuCielo collects and uses which pertains to you may be publicly available via government records, commercially available listings, and other widely available media (i.e. the Internet).
Other Uses and Disclosures
TuCielo also uses and discloses your Personal Information as necessary or appropriate, in particular when there is a legal obligation or legitimate business interest to do so:
- To comply with applicable law and regulations, which may include laws outside your country of residence.

- To respond to a request or to provide information TuCielo believes is important.

- TuCielo has a legitimate interest in disclosing or transferring your Personal Information to a third-party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).
- TuCielo Systems may collect the physical location of your device by, for example, using satellite, cell phone tower or WiFi signals. TuCielo may use your device’s physical location to provide you with personalized location-based services and content.
- TuCielo may use analytics services, including Google Analytics Earth, or Maps features, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources. INFORMATION YOU PROVIDE
TuCielo collects several types of information from users of our Systems for legitimate business purposes, including information by which you may be personally identified (such as name, address, e-mail address, telephone number, social security number or any other information defined as personal or personally identifiable information under applicable law); and/or information about your internet connection, the equipment you use to access our Website and usage details. TuCielo collects the personal information you provide when:
- You use our planning tools or apply for financing;
- You contact TuCielo with questions, concerns, complaints or questions;
- You participate in a promotion or online survey;
- You navigate through the Systems and such information is entered into Systems or collected automatically.
- Information collected automatically may include usage details, IP addresses and information collected through cookies and other tracking technologies; and/or
- Third parties provide such information to us, for example, our business partners, vendors, or contractors.
Unless TuCielo requests it, TuCielo asks that you do not send us through the Systems; or otherwise disclose to us, any sensitive Personal Information including payment card or account information, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background information, or trade union memberships.
INFORMATION COLLECTED FROM OTHER SOURCES
TuCielo may also collect information about you from third-party consumer reporting agencies or other commercially available third-party resources. TuCielo may use this information to process and approve your financing application, to verify your identity, and to offer you products that may be of interest to you. TuCielo may receive information regarding you, your property, your proposed or installed improvements, or other products, from third parties in order to process and approve your financing application.
MONITORING AND RECORDING TELEPHONE CALLS AND TEXT MESSAGES
TuCielo may monitor and/or record telephone calls for compliance, security, and customer service purposes. Please be aware that by calling TuCielo you consent to having your phone call monitored and/or recorded.
TuCielo may also send text messages regarding status updates, inquiries, follow-up messages, or for marketing our products and services. You may receive frequent messages when your application is active and under review. You may opt out of these text messages by following the instructions in the text or texting STOP at any time. Message and data rates may apply.
If you are a United States resident using the Services, you represent and warrant that:
- You are at least 18 years old,
- You live in the United States,
- You are the account holder for the telephone numbers you provide, or you have authorization from the account holder(s) to provide consent, and
- The telephone numbers you provide are accurate, and you will let us know if you release them to a third-party.
Do Not Call Policy
This notice is TuCielo’s Do Not Call Policy under the Telephone Consumer Protection Act. Unless applicable law allows or you provide consent, TuCielo does not solicit via telephone numbers listed on the National Do Not Call Registry or any State Do Not Call list or any internal Do Not Call list.

By sharing your telephone number with TuCielo, you agree that TuCielo may contact you at the telephone number you provided, even if your number is on a federal, state, or internal Do Not Call list, and you consent to receive status updates, in process communications, marketing communications, and/or texts to you on the phone number provided. In addition your consent applies to use of an automated system for selection or dialing of numbers or pre-recorded or artificial voice messages that relate to in process or marketing communications for financial products or services. Your consent is not required to purchase products or services. You may unsubscribe at any time.
Changes to Consent and Opting Out of Calls & Texts
You may revoke your consent to receive calls and text messages from us at any time by emailing us at the Contact Us page . To opt out of receiving text messages from us, please follow the opt-out instructions in a text message sent by us. Please allow up to 30 days for us to process such changes or opt-out requests.
Email Communications
TuCielo may collect your email address to communicate with you for transactional or marketing purposes. By providing your email address you confirm you are the owner of that email address.
Opting Out of Marketing Communications
TuCielo gives you choices regarding our use of your Personal Information for marketing purposes. You may opt-out from receiving marketing-related emails from us. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out via the opt-out link in the message itself. If you would like to opt-out of receiving marketing-related emails, send a request to marketing@tucielo.com.
Affiliate Sharing
TuCielo may share information about your transaction and experience or creditworthiness with our affiliated companies. TuCielo may also share your information for marketing purposes. Federal law gives you the right to limit sharing information about your creditworthiness for everyday business purposes or sharing your information with affiliates for marketing. If you want to limit sharing with affiliates by emailing marketing@tucielo.com.
TECHNICAL INFORMATION
TuCielo uses technology to:
- Gather technical information from your Web browser (IP address, operating systems);
- Set persistent cookies on your computer; and
- Use “action tags” or invisible tracking “gifs” on our systems (to collect information about your navigation throughout our Website and/or third-party websites and mobile applications).
Using Cookies and/or Pixel Tags
Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information, including browser type, time spent on the Systems, pages visited, language preferences, and other traffic data. TuCielo and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, to improve the Systems, and to personalize your experience. TuCielo also gathers statistical information about use of the Systems in order to continually improve their design and functionality, understand how they are used, and assist us with resolving questions regarding them. Cookies further allow selection of which of our advertisements or offers are most likely to appeal to you and display them while you are using the Systems. TuCielo may also use cookies or other technologies in online advertising to track responses to our ads. Relatedly, advertising networks may collect Personal Information by using cookies, and most advertising networks offer you a way to opt-out of targeted advertising. Pixel tags (also known as web beacons and clear GIFs) or similar technology may be used to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns, serve you with advertisements, and compile statistics about usage of the Services and response rates.
TuCielo uses this information for routine website maintenance, to establish that you are a unique user, to assist you in the financing process, and/or for purposes of assessing the effectiveness of our website.
TUCIELO PROTECTS YOUR INFORMATION
TuCielo endeavors to use reasonable organizational, technical, and administrative measures to protect Personal Information within our organization including the security measures provided below. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, or if you believe you have identified a security vulnerability, please immediately notify us in accordance with the “Contact Us” section.
- With Secure Sockets Layer (SSL) technology supporting up to 128-bit encryption to prevent unauthorized parties from viewing personal information transmitted to or from our Systems;
- By limiting access to your personal information to only those authorized parties that have a “need to know” or that you have authorized; and
- As otherwise provided in this Policy.
DOES TUCIELO SHARE YOUR PERSONAL INFORMATION WITH THIRD PARTIES?
TuCielo does NOT share your personal information with non-affiliated third-parties nor does TuCielo allow third-party advertisers to track your browsing activities on our Website for their own purposes. TuCielo will only share your email or other contact information with third-party advertising and social media companies to perform functions on our behalf or to provide you with information regarding TuCielo products and services which may be of interest to you. TuCielo also may share your personal information (including, but not limited to, your contact information):
- With parties involved in the financing process or your request for financing;
- With parties who service the contractual assessment;
- With parties that perform services on our behalf;
- With parties that install Eligible Improvements;
- With parties as authorized by you;
- As required by law.
Subject to applicable law, if you wish to opt out of TuCielo marketing communications and not have your information shared with third-party companies, please update your communication preferences.
HOW LONG WILL YOUR INFORMATION BE STORED?
TuCielo maintains electronic and hard copy financing application information for funded/closed/withdrawn financing for a period of 7 years or longer if in accordance with federal and state laws or for as long as permitted to comply with applicable law.

WILL THIS PRIVACY POLICY CHANGE?
The “Effective Date” at the bottom of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when TuCielo posts the revised Privacy Policy on the Services. You are responsible for ensuring TuCielo has an up-to-date, active, and deliverable email address for you and for periodically visiting this Privacy Policy to check for any changes. Your continued use of the Systems following any changes means that you accept the revised Privacy Policy. If you do not agree with our policies and practices outlined in this Privacy Policy, your choice is to discontinue use of the Services. It is our policy to post any changes TuCielo makes to our Privacy Policy on our Systems. If TuCielo makes a material changes to how TuCielo treats our users’ personal information, TuCielo will notify you by e-mail to the primary e-mail address specified in your account and/or through a notice on our Website home page.
